Overseas students studying in Australia make a significant contribution to the cultural and economic life of Australia. The Australian Government recognises this and has made it easier for overseas students who gain professional or trade qualifications in Australia to remain permanently in Australia after completing their studies.

In September 2007 a new Skilled Graduate visa was created that allows certain students to work without restriction in Australia for 18 months after graduation. If you apply for a Graduate visa you will be granted a bridging visa with work rights which will allow you to stay in Australia until your skilled visa is decided.

Studies requirement for applying for an on-shore skilled visa at the end of your course

Two year study rule

If you complete a degree, diploma or trade level qualification that is 2 academic years in duration you may be able to apply for a skilled visa without leaving Australia. Not all courses will result in you being able to apply for a visa at the end of your studies, as your course needs to be registered on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS) website, be at least 92 weeks in duration, and be related to an occupation on the Skilled Occupations List (SOL).

If your course does not satisfy these elements, and you want to apply for a visa without leaving Australia, you should consider changing your enrolment to a course that satisfies the two year study rule.

We recommend that you study a course that is related to a 50 or 60 point occupation on the SOL and in which you can be accredited on the basis of your qualifications alone. You can compress your studies into 16 calendar months as long as the course has an academic weighting on CRICOS of 92 weeks.

Requirements for applying for an on-shore skilled visa

To apply for a skilled visa without leaving Australia you must satisfy the following requirements:

  • satisfy the “two year study rule”
  • be less than 45 years old
  • apply for accreditation in one of the 300 occupations on the SOL
  • apply to take the medical exam and apply for your police clearances
  • apply to take the IELTS (you must score 6 out of 9 on each part of the IELTS)
  • apply for the visa within 6 months of finishing your studies, and preferably, before your student visa expires

Visa options

Skilled Independent visa

The Skilled Independent visa is a permanent visa that allows you and your family to live and work in Australia for as long as you want. After four years in Australia in total you can apply for Australian citizenship.

To be eligible for a Skilled Independent visa you must have studied in an area closely related to a 50 or 60 point occupation on the SOL, meet the above requirements, and score 120 points in the points test.

Skilled Regional Sponsored visa

The Skilled Sponsored visa allows you and your family to live, work and study in regional Australia for three years. After two years in regional Australia you can apply for a permanent visa, and two years after that you can apply for Australian citizenship.

To be eligible for a Skilled Sponsored visa you must have studied in an area closely related to a 50 or 60 point occupation on the SOL, meet the above requirements, be sponsored by a state or territory government, and score 100 points in the points test.

Skilled Graduate visa

A Skilled Graduate visa allows you and your family to live, work and study in Australia for 18 months after completing your studies. You do not need to pass the points test, and if you are not eligible for any other skilled visa, this is the best visa to apply for.

To be eligible for a Skilled Graduate visa you must study in an area closely related to an occupation on the SOL and meet the above requirements.

In practical terms, to become eligible for a permanent visa as the holder of a Graduate visa you must work in an area related to your studies for 12 months. WARNING: Be aware that if you do not work in your professional area for 12 months while holding this visa you may not be eligible for a further work visa.
